MEMBERSHIP RELEASE OF LIABILITY AND ASSUMPTION OF RISK AGREEMENT

This Release of Liability and Assumption of Risk Agreement ("Agreement") is entered into by the undersigned member ("Member") in favor of PATRIOT FITNESS LIFE LLC, doing business as G13BJJ of Colorado ("G13BJJ CO"), located at 13790 E. I-25 Frontage Rd, Unit C5, Mead, Colorado 80504.

In consideration for being accepted as a member and being permitted to participate in Brazilian Jiu-Jitsu, grappling, martial arts instruction, fitness training, fundamentals, advanced and no-gi classes, open mat sessions, belt promotions, seminars, in-house tournaments, outside competitions, and all related activities, whether held at the academy or at any other location (collectively, the "Training Activities"), Member agrees as follows:

1. TERM OF THIS AGREEMENT

This Agreement applies to every visit and every activity from the date it is signed forward, for the entire duration of the membership and any renewal, extension, freeze, or reinstatement of it. Member will not be asked to sign a new release before each class, and none is required for this Agreement to remain in effect.

2. ACKNOWLEDGMENT OF INHERENT RISKS

Member understands and acknowledges that martial arts and physical training activities involve inherent risks, including but not limited to:

• physical contact, grappling, sparring, live rolling, and close-quarters partner drilling
• joint manipulation, joint locks, and choking or strangulation techniques
• throws, takedowns, falls, and impacts with the mat, walls, equipment, or other participants
• training with partners of different size, strength, age, and experience level
• sprains, strains, dislocations, fractures, concussion, skin infection, or other serious injury
• permanent disability, paralysis, or death

Member voluntarily chooses to participate with full knowledge of these risks.

3. ASSUMPTION OF RISK

Member knowingly and voluntarily assumes all risks, both known and unknown, arising from participation in the Training Activities, INCLUDING RISKS RESULTING FROM THE ORDINARY NEGLIGENCE OF G13BJJ CO, ITS INSTRUCTORS, ITS STAFF, OR OTHER PARTICIPANTS.

4. RELEASE OF LIABILITY

To the fullest extent permitted by Colorado law, Member releases, waives, and discharges PATRIOT FITNESS LIFE LLC, its owners, members, managers, officers, instructors, employees, independent contractors, agents, volunteers, and representatives ("Released Parties") from any and all claims, demands, damages, losses, or causes of action of any kind arising out of or related to participation in the Training Activities, INCLUDING CLAIMS BASED ON THE ORDINARY NEGLIGENCE OF THE RELEASED PARTIES.

Member understands that by signing this Agreement, Member is giving up substantial legal rights, including the right to sue the Released Parties for injuries caused by their ordinary negligence.

This release does not apply to claims arising from willful and wanton conduct, gross negligence, or any liability that may not lawfully be released under Colorado law.

5. COVENANT NOT TO SUE

Member agrees not to file or pursue any lawsuit, claim, or legal action against the Released Parties for injuries, damages, or losses arising from participation in the Training Activities.

6. PHYSICAL CONDITION AND MEDICAL AUTHORIZATION

Member certifies that they are physically able to participate in the Training Activities and have disclosed below any medical condition, injury, or limitation that could increase the risk of injury or that instructors should know about. Member agrees to inform G13BJJ CO of any new injury or medical condition that arises during the membership.

Known medical conditions, injuries, or limitations (write "none" if none):

In the event of an emergency, Member authorizes G13BJJ CO staff to summon emergency medical assistance and to obtain emergency medical treatment if deemed necessary. Member understands that all resulting medical expenses are their sole responsibility, and that G13BJJ CO does not provide medical, health, or accident insurance for its members.

7. RULES, HYGIENE, AND CONDUCT

Member agrees to follow the academy rules and the reasonable instructions of the instructors and staff at all times, to train with control and respect for training partners, to keep fingernails and toenails trimmed, to arrive with clean uniform and body, and not to train while carrying a contagious skin condition or illness. G13BJJ CO may suspend or end a membership for conduct that endangers other members.

8. PERSONAL PROPERTY

G13BJJ CO is not responsible for loss of or damage to personal property brought onto the premises, including items left in changing areas, lockers, or vehicles.

9. MEMBERS UNDER 18 YEARS OF AGE

If Member is under 18 years of age, this Agreement must be signed by the Member's parent or legal guardian, who represents that they have legal authority to act on the minor's behalf.

By signing, the parent or legal guardian:

• consents to the minor's participation in the Training Activities
• acknowledges and assumes, on behalf of the minor, all risks described in this Agreement
• AGREES, ON BEHALF OF THE MINOR AND ON THEIR OWN BEHALF, TO RELEASE AND WAIVE THE MINOR'S PROSPECTIVE CLAIM FOR NEGLIGENCE AGAINST THE RELEASED PARTIES, AS EXPRESSLY PERMITTED BY SECTION 13-22-107 OF THE COLORADO REVISED STATUTES
• agrees to be bound by all terms of this Agreement

The parent or legal guardian understands that this waiver means the minor may be unable to recover damages from the Released Parties for injuries caused by their ordinary negligence.

10. PHOTO AND MEDIA RELEASE (OPTIONAL)

Check this box if you consent to G13BJJ CO photographing or recording classes, promotions, and competitions in which you or your minor child appear, and using those images on its website, social media, and promotional material, without compensation. This is optional and does not affect your membership.

11. GOVERNING LAW AND VENUE

This Agreement shall be governed by and interpreted under the laws of the State of Colorado, without regard to its conflict of law provisions. Any action arising out of this Agreement shall be brought in the state courts located in Weld County, Colorado.

12. SEVERABILITY

If any provision of this Agreement is held invalid or unenforceable, that provision shall be severed and the remaining provisions shall remain in full force and effect.

13. ACKNOWLEDGMENT OF UNDERSTANDING

Member acknowledges that:

• they have read this Agreement carefully and in its entirety
• they understand its contents
• they understand they are giving up substantial legal rights, including the right to sue for ordinary negligence
• they understand this Agreement stays in effect for as long as the membership continues
• no oral representations, statements, or inducements apart from this written Agreement have been made
• they sign freely and voluntarily
