GUEST AND TRIAL CLASS RELEASE OF LIABILITY AND ASSUMPTION OF RISK AGREEMENT
This Release of Liability and Assumption of Risk Agreement ("Agreement") is entered into by the undersigned participant ("Participant") in favor of PATRIOT FITNESS LIFE LLC, doing business as G13BJJ of Colorado ("G13BJJ CO"), located at 13790 E. I-25 Frontage Rd, Unit C5, Mead, Colorado 80504.

In consideration for being permitted to participate in a trial class, guest visit, or introductory session involving Brazilian Jiu-Jitsu, grappling, martial arts instruction, fitness training, open mat sessions, and all related activities (collectively, the "Training Activities"), Participant agrees as follows:
1. ACKNOWLEDGMENT OF INHERENT RISKS
Participant understands and acknowledges that martial arts and physical training activities involve inherent risks, including but not limited to:
- physical contact, grappling, and close-quarters partner drilling
- joint manipulation, joint locks, and choking or strangulation techniques
- throws, takedowns, falls, and impacts with the mat, walls, equipment, or other participants
- sprains, strains, dislocations, fractures, concussion, or other serious injury
- permanent disability, paralysis, or death

2. ASSUMPTION OF RISK
Participant knowingly and voluntarily assumes all risks, both known and unknown, arising from participation in the Training Activities, INCLUDING RISKS RESULTING FROM THE ORDINARY NEGLIGENCE OF G13BJJ CO, ITS INSTRUCTORS, ITS STAFF, OR OTHER PARTICIPANTS.
3. RELEASE OF LIABILITY
To the fullest extent permitted by Colorado law, Participant releases, waives, and discharges PATRIOT FITNESS LIFE LLC, its owners, members, managers, officers, instructors, employees, independent contractors, agents, volunteers, and representatives ("Released Parties") from any and all claims, demands, damages, losses, or causes of action of any kind arising out of or related to participation in the Training Activities, INCLUDING CLAIMS BASED ON THE ORDINARY NEGLIGENCE OF THE RELEASED PARTIES.
Participant understands that by signing this Agreement, Participant is giving up substantial legal rights, including the right to sue the Released Parties for injuries caused by their ordinary negligence.
This release does not apply to claims arising from willful and wanton conduct, gross negligence, or any liability that may not lawfully be released under Colorado law.
4. COVENANT NOT TO SUE
Participant agrees not to file or pursue any lawsuit, claim, or legal action against the Released Parties for injuries, damages, or losses arising from participation in the Training Activities.
5. PHYSICAL CONDITION AND MEDICAL AUTHORIZATION
Participant certifies that they are physically able to participate in the Training Activities and have disclosed below any medical condition, injury, or limitation that could increase the risk of injury or that instructors should know about.

In the event of an emergency, Participant authorizes G13BJJ CO staff to summon emergency medical assistance and to obtain emergency medical treatment if deemed necessary. Participant understands that all resulting medical expenses are their sole responsibility.

6. PARTICIPANTS UNDER 18 YEARS OF AGE
If Participant is under 18 years of age, this Agreement must be signed by the Participant's parent or legal guardian, who represents that they have legal authority to act on the minor's behalf.
By signing, the parent or legal guardian:
- consents to the minor's participation in the Training Activities
- acknowledges and assumes, on behalf of the minor, all risks described in this Agreement
- AGREES, ON BEHALF OF THE MINOR AND ON THEIR OWN BEHALF, TO RELEASE AND WAIVE THE MINOR'S PROSPECTIVE CLAIM FOR NEGLIGENCE AGAINST THE RELEASED PARTIES, AS EXPRESSLY PERMITTED BY SECTION 13-22-107 OF THE COLORADO REVISED STATUTES
- agrees to be bound by all terms of this Agreement
The parent or legal guardian understands that this waiver means the minor may be unable to recover damages from the Released Parties for injuries caused by their ordinary negligence.

7. PHOTO AND MEDIA RELEASE (OPTIONAL)
Check this box if you consent to G13BJJ CO photographing or recording classes in which you or your minor child appear, and using those images on its website, social media, and promotional material, without compensation. This is optional and does not affect your ability to train.
8. GOVERNING LAW AND VENUE
This Agreement shall be governed by and interpreted under the laws of the State of Colorado, without regard to its conflict of law provisions. Any action arising out of this Agreement shall be brought in the state courts located in Weld County, Colorado.
9. SEVERABILITY
If any provision of this Agreement is held invalid or unenforceable, that provision shall be severed and the remaining provisions shall remain in full force and effect.
10. ACKNOWLEDGMENT OF UNDERSTANDING
Participant acknowledges that:
- they have read this Agreement carefully and in its entirety
- they understand its contents
- they understand they are giving up substantial legal rights, including the right to sue for ordinary negligence
- no oral representations, statements, or inducements apart from this written Agreement have been made
- they sign freely and voluntarily
